Checking an Arbeitsvertrag before starting
Before an Iranian national starts work in Germany, check both the Arbeitsvertrag and the work permission on the residence document. A job offer or signed contract does not itself remove an employer restriction or other immigration limit.
Step by step
- Review termsRead the essential employment terms and resolve unclear pay, hours or termination clauses with the employer.
- Verify permission before startingCheck your residence document and obtain any necessary change of restriction from the immigration office before working outside its scope.
Check the parties, role, workplace, start date, any fixed term or probation, pay components, working time, leave and termination arrangements. These are among the essential terms covered by the employer’s evidence duties in § 2 NachwG. Clarify anything you do not understand before agreeing.
Your residence document must show whether work is allowed and what limits apply. Where the title authorises a specific job, another job requires the competent authority’s permission unless a statutory exception applies. Compare the proposed employer and role with those conditions before starting; keep the contract and the applicable permission together.
