Kündigung durch den Arbeitgeber: act promptly
Iranian employees dismissed in Germany should record when the written notice arrived and seek prompt assessment. A court challenge normally has a three-week deadline. Separately arrange job-seeker registration and check any residence notification duties.
Step by step
- Preserve notice and check deadlinesRecord receipt, obtain prompt advice about a court claim and complete the separate employment-agency and residence notifications that apply.
Dismissal requires written form; an electronic message does not meet §623 BGB. The applicable notice period depends on the circumstances, including service length and contract or collective rules. General unfair-dismissal protection also depends on factors such as employment duration and establishment size; do not assume a small employer removes every protection.
To challenge a written dismissal, the ordinary deadline under §4 KSchG is three weeks after receipt; special authority-approval cases have a different trigger. Keep the envelope and notice and obtain prompt advice. Register as job-seeking within the applicable §38 deadline. Where employment tied to a qualifying residence permit ends prematurely, notify the foreigners authority under §82(6); a court claim does not replace these notifications.
