Challenging an asylum decision: Klage
An Iranian applicant who wants to challenge a German asylum decision should read its legal-remedy notice immediately and obtain urgent advice. The lawsuit period is generally two weeks, but specified cases have one week; a separate urgent court application may be necessary.
Step by step
- Act on the notice immediatelyRecord the delivery date, bring the full notice to urgent legal or asylum-procedure advice, and arrange the required lawsuit and any interim application within the actual deadlines.
The exact decision type and legally relevant delivery date matter. Preserve the complete notice and delivery evidence. Section 74 AsylG distinguishes lawsuit periods; do not calculate your deadline from a generic account of another person’s Iranian asylum case.
A lawsuit and an application for interim protection serve different purposes. Sections 36 and 34a specify short periods for certain urgent applications. Ask a lawyer or independent asylum adviser promptly which court and applications your notice requires; do not assume that contacting BAMF stops a deadline or that a lawsuit always stops removal.
