Scheidung: check the Iranian cross-border case
Iranian spouses living in Germany should obtain family-law advice on jurisdiction, applicable law and recognition before filing for divorce. Give all nationalities and residence or protection statuses; a German address alone does not settle the Iranian legal issues.
Step by step
- Obtain an individual legal assessmentGive a family lawyer the marriage and nationality history, clarify the court and applicable law, and separately check recognition of any Iranian or German decision.
German divorce proceedings generally require a lawyer for the application, although the law exempts certain acts such as merely consenting to divorce. Tell the lawyer about the Iranian marriage record, any previous proceedings, all citizenships and protection status. The Berlin Senate identifies the German-Iranian settlement agreement as relevant where both spouses have exclusively Iranian nationality; do not apply a generic German-law checklist without assessment.
Divorce and its recognition across borders are separate issues, as are maintenance, property and child matters. An Iranian divorce is not handled under the EU automatic-recognition route. A home-state decision can avoid a formal recognition procedure only under specific conditions, including no different personal status; German dual nationality can change the result. Have the competent authority assess the actual decision before remarriage or register changes.
